Since our formation as a non-profit advocacy organization in late 2018, CPR – The Center for Physician Rights Inc. has striven to design a specialized program that could help physicians protect their legal rights in their encounters with state medical licensing boards, physician health programs and peer review or performance appraisal committees. These are generally non-overseen and non-accountable entities who hold immense power over physicians’ careers.

We envisioned a program with a stratified menu of offerings, a program that validated physicians’ concerns about the reality of potentially grave harms from infringement of their rights, and provided a knowledgeable resource by which to “sound out,” make sense of, and navigate their case. It would be one that could offer a thoughtful case analysis and an exploration of potential approaches and risks. And it would be a program that could provide ongoing guidance and support as one fought to defend their rights, have a fair hearing, and bring the matter to prompt and optimal closure.

CPR’s “Comprehensive Case Overview Program”

CPR’s Comprehensive Case Overview Program joins together the initial sound out “curbside consultation” with a more in-depth case review.

Subsequent to it, an optional mentoring program is offered to assist physicians who would like guidance as they navigate the perilous medical regulatory territory, namely state medical licensing boards, physician health programs (PHPs) and hospital peer review (or alternately performance appraisal or annual review) entities. We’ve come to refer to these functional entities as the Medical Regulatory Therapeutic Complex (MRTC).

While we initially focused on non-academic clinical physicians practicing in the community, we widened the scope of the Comprehensive Case Overview Program to assist physicians in academic clinical practices and ACGME post-graduate training programs (PGYs, i.e. interns, residents and fellows, and in some cases medical students) who may be similarly confronting threatened credentialing, employment or license restriction on alleged mental health, substance abuse or adverse peer review / peer review / performance appraisal concerns.

Format of the Comprehensive Case Overview Program

The Comprehensive Case Overview Program consists of a total of 8 “session unit hours” devoted to in-depth case study and interactive discussion.

Generally, the Comprehensive Case Overview Program’s consultation session will have been preceded by an initial “curbside consultation” which will have provided an initial case framework by which to understand the landscape and contours of the current challenge.

Prior to our extended case consultation meeting, the client will have completed a more fully detailed case narrative elaborating on the history of the present challenge and all relevant details through the present. This expanded narrative is critically important as it serves as the basis for our initial case consultation meeting and our joint understanding of the full case. Prior to our initial consultation meeting, up to 60 minutes is allocated for my study of the submitted narrative material.

The initial consultation meeting then affords a fuller exploration of your current Board, PHP, or credentialing / peer / performance review matter. During this session, we formulate our understanding about the essential issues in the case and preliminarily explore potential approaches. By the end of this consultation session (90 - 120 minutes), you and I will have a better idea of the key issues at hand, their implications, and considerations of next steps. It is recommended that up to 30’ of this initial meeting be devoted to review of our discussion and the presented materials, and the approaches discussed. Private notations may be made as reminders for our ensuing meetings or for various action items to consider. The client is strongly encouraged to take notes during and after the consultation for their own private benefit. As a general principle, narrative notes in the manner of consultation reports or progress notes are not kept.

All non-session time is allocated at the outset of the program and drawn from in the manner of a retainer.

Our subsequent 1-to-1 sessions (three total) explore the actions you have taken, and pursue deeper exploration of key challenges elucidated in the initial consultation. They may also focus on new developments that have arisen (which is often the case in these matters).

Two hours of non 1-to-1 session time is reserved for my professional time devoted to studying and commenting on materials you have submitted, correspondence you are drafting, relevant issue research, and confidential communication with external parties, e.g. a lawyer familiar with such matters, and for other case related activities as may arise. In the event that more time is needed for these activities, you will be advised and can apply a 1-to-1 session credit towards this or purchase additional professional time as needed. Prior to the last session of your package, should there be a greater than 30 min balance of non-1-to-1 session time remaining, this can be applied toward the final (“recap”) session or to a newly added session.

This very focused program’s services are designed to be utilized over the course of two months.

If your case overview requires more time for completion, you can purchase a one-time Comprehensive Case Overview Program extension or simply continue into the 12 session Mentoring Program (see separately).

It is recommended that the last session of the Comprehensive Case Overview Program serve as a recap summarizing the key issues and potential approaches. And at that time, we can then explore whether continued mentoring services might be beneficial as your case moves forward.

* Meeting varies in length 90-120’; it is recommended that at least 30’ be devoted to initial recap and frame of approach.

** Our closing session is reserved for recap of case essentials, strategies, and contingencies, and for envisioning steps moving forward, including discussion of client’s interest in continuing guidance through the mentoring program.

*** If there is greater than 30’ non-session time toward the end of the program, that time can be applied toward a correspondingly time-allotted one-to-one session.

One-to-one sessions (up to 5 hours total) include the comprehensive case consultation meeting (generally 90-120 min) and three 1-1 Zoom (or phone) sessions.

Non-one-to-one session time (up to 3 hours of “non-session case time”) includes off-line document review / editing / revising; case-related research; and external communication, e.g. with a legal resource.

The 8 hours of session unit time in the program is interchangeable as needed between one-to-one sessions and non-session case time.

Additionally, given CPR’s increasing visibility as a physician rights advocacy organization which challenges potential rights-infringement by various parties in the MRTC arena, it may be in your best interest not to disclose your engagement as a client in any of CPR’s programs.
